Over
the years, aviation law and practice in
Nigeria has been guided increasingly liberal
government policy, encouraging further private
participation in the industry.
In
particular, the firm was involved in advising
on and putting together the comprehensive
package of bid documentation relating to
the proposal by the Nigerian Ministry of
Defence/Nigerian Air Force to acquire Military
Training Aircraft from Slingsby Aviation
Of The Republic Of Ireland.
The
firm has also rendered advice on the creation
of security interests upon acquisition of
commercial (passenger) aircraft by a foreign
client, with further advice being rendered
at the request of foreign solicitors upon
the consequences and effects of registration
of such interests with the Federal Ministry
of Aviation in Nigeria. F.O. Akinrele &
Co has also rendered advice to various clients,
local and international, on areas including
aircraft finance and charter arrangements,
insurance claims under aviation policies
and relatd subrogation claims. F.O. Akinrele
& Co. has also given extensive advice
to BAE (SYSTEMS) LTD. (British Aerospace)
on establishing and doing business in Nigeria.
The
firm has conducted litigation on behalf
of international owners of aircraft, such
as Arjay Limited, Streamline Aviation Limited
And Willow Jet Limited / Air Tabernacle
Limited (all U.K. based companies) against
local charterers of aircraft from High Court
to Supreme Court level, regarding breaches
of aircraft lease agreements, release of
aircraft from judicial arrest and other
related issues.
The
firm has conducted litigation on behalf
of a Belgian client (European Organisation
For Safety Of Air Navigation ("Eurocontrol")
against its local airline customers in default
of fee payments due upon air navigation
cervices rendered to private Nigerian Airlines.
In
the wake of the current administration's
commitment to turning around Nigeria's ailing
public utilities for the better through
a rigorous privatization programme, F.O.
Akinrele & Co. has been deeply involved
in the exercise, either from the point of
view of the investor or the BPE.
The
firm is currently part of a consortium,
which is currently being considered for
the privatization of Federal Aviation Authority
of Nigeria.
